Welcome to the official inTrentino online shop (www.intrentino.com), a service owned by Federazione Trentina della Cooperazione, based in Trento at Via Segantini, 10 – Business Register TN | Tax Code and VAT No. 00110640224 | Registration with the National Register of Cooperative Entities MU-CAL n. A157943 (hereinafter “FTCOOP”), offered in collaboration with the participating cooperatives (hereinafter “COOP”).

Users are invited to carefully read the General Terms and Conditions of Sale set out below, which constitute a legally binding agreement for the use of the online shop and the purchase of goods contained therein.

The General Terms and Conditions of Sale are made available to online shop users also to allow them to be stored and reproduced pursuant to Article 12 of Legislative Decree No. 70 of 9 April 2003.

1. OBJECT

1.1 These online General Terms and Conditions of Sale (hereinafter “GTC”) govern the contract (hereinafter “CONTRACT”) for the sale of products (hereinafter “PRODUCTS”) sold by the COOP through the website www.intrentino.com (hereinafter “site”) owned by FTCOOP to the users of the site (hereinafter “CUSTOMER” or “CUSTOMERS”).

1.2 In these GTC, the terms CUSTOMER or CUSTOMERS refer to the “consumer” or “consumers” pursuant to Article 3, paragraph 1, letters a) of Legislative Decree No. 206 of 6 September 2005 (hereinafter “CODE”), meaning “the natural person acting for purposes outside any business or professional activity they may carry out”.

1.3 The appearance of delivered products may not exactly match that shown on the website if the packaging has been changed. Product photographs on the site are for illustrative purposes only, and items may undergo graphical changes to the packaging compared to what is presented.

2. EFFECTIVENESS AND MODIFICATION OF THE GTC

2.1 The GTC are available on the site to be easily read by the CUSTOMER before registration and before purchasing PRODUCTS; they are considered accepted together with the CUSTOMER’s registration on the site and/or together with the submission of the order form in the case of an unregistered CUSTOMER, and may be stored on the CUSTOMER’s computer and reproduced on paper by printing the file in which they are contained.

2.2 The GTC applicable to the sale of PRODUCTS are those published on the site on the date of the relevant order. Therefore, the CUSTOMER must review the GTC each time they intend to make a purchase on the site. Any new GTC will become effective upon publication on the site and will apply only to sales concluded after such publication.

The CUSTOMER acknowledges that these GTC are available directly on the FTCOOP e-commerce platform at www.intrentino.com and that FTCOOP has complied with the legal requirements both regarding making the GTC available and communicating information to the consumer.

2.3 The mere tolerance or failure by FTCOOP or the COOP to contest any non-compliance by the CUSTOMER with the GTC cannot be interpreted as tacit acceptance of such non-compliance, nor as a willingness to waive what has been agreed between the parties.


3. REGISTRATION AND PURCHASE PROCEDURE

3.1 The CUSTOMER who wishes to purchase PRODUCTS may express this intention through two distinct methods:

Creating an account by completing the personal information requested in the appropriate section of the site. Once registered, it will be possible to:

  • Access the site with their profile;

  • Keep the shopping cart saved before completing payment;

  • Avoid entering personal/shipping/billing data during order placement;

  • Modify personal data;

  • Save orders in the “order history” section.

Banking data are not requested during registration or order entry, but directly at the time of payment through the PayPal and Shopify systems, which retain exclusive access.

Submitting a request directly on the site, following the purchase procedure indicated, sends the electronic order (hereinafter “ORDER”) and payment electronically. The CUSTOMER must keep login credentials confidential, as any unauthorized disclosure resulting in an order placed via the site will bind the CUSTOMER to pay the price.

3.2 The order form contains a summary of the essential characteristics of each ordered product and the corresponding price (including all applicable taxes), the chosen payment method, the delivery methods for purchased products, and shipping and delivery costs. The CUSTOMER must carefully review all information and correct any data entry errors using the appropriate website functions before submitting the ORDER.

3.3 The order submitted by the CUSTOMER will be binding for the COOP only if the entire order procedure has been completed correctly without any error messages. All product orders are subject to availability and must be confirmed by FTCOOP, which will send a CONFIRMATION OF ORDER email to the CUSTOMER. The contract is considered concluded only upon sending this email.

3.4 In case of non-execution of the ORDER due to unavailability of one or more PRODUCTS, the CUSTOMER will be informed via email and asked to confirm whether they wish to proceed with the purchase of the remaining available PRODUCTS.

Unavailability of one or more PRODUCTS does not automatically cancel the entire ORDER, which remains at the CUSTOMER’s discretion, provided they notify FTCOOP via email at ordini@intrentino.com.

3.5 The CONTRACT between the CUSTOMER and COOP is governed by the ORDER, the CONFIRMATION OF ORDER, the GTC, and the Privacy Policy (hereinafter “PRIVACY”), all published on the site.

3.6 CUSTOMERS are informed that the concluded contract will be stored in FTCOOP archives and can be accessed by submitting a motivated request to ordini@intrentino.com or by writing to FTCOOP headquarters by registered mail.

3.7 Issuing an invoice is not mandatory unless requested by the CUSTOMER at the time of order placement, as indicated in DPR 26/10/1972 n. 633 – art.22.

4. RIGHTS AND OBLIGATIONS OF COOP

4.1 COOP undertakes to deliver the PRODUCTS to the address indicated by the CUSTOMER in the ORDER. FTCOOP and COOP shall not be responsible for delivery errors due to inaccuracies or incompleteness in the CUSTOMER’s personal details or in the ORDER, or due to the CUSTOMER being unavailable. Delivery is carried out via express courier; therefore, PO boxes cannot be accepted.

4.2 In case of total return of PRODUCTS that are damaged or different from the ORDER, COOP will arrange for the replacement of the goods or the refund of the order, as indicated in paragraph 9 ‘RETURNS AND REFUNDS’.

4.3 Except as provided in paragraph 1.3, COOP grants the CUSTOMER the legal warranty of conformity on the PRODUCTS sold, in accordance with the provisions of the Consumer Code.

5. RIGHTS AND OBLIGATIONS OF THE CUSTOMER

5.1 The CUSTOMER is solely responsible for the accuracy of the data and the correctness of the information provided to FTCOOP during registration or when purchasing PRODUCTS through the site and undertakes to promptly communicate any changes to the data entered. For ORDERS, any changes must be communicated exclusively within the time limits set out in paragraph 10.1.

5.2 The CUSTOMER, during registration and/or submission of the ORDER, declares to have read, understood, and accepted the GTC and other information contained on the site, including the PRIVACY Policy.

5.3 The CUSTOMER undertakes, once the purchase procedure on the site is completed, to save both an electronic copy and a printed version of the ORDER and the GTC for their records, as indicated in article 2.1.

5.4 The CUSTOMER undertakes to place ORDERS for a minimum value of €25.00 excluding shipping costs. ORDERS below this value will not be considered valid or effective and will not be delivered.

The system will notify the CUSTOMER if the minimum purchase requirement has not been met.

6. USE OF THE SITE

6.1 The essential characteristics of the PRODUCTS are presented on the site within each product sheet. Images and colors of the products offered for sale on the site may not perfectly correspond to the real ones due to the Internet browser and monitor used at the time of connection.

6.2 FTCOOP assumes no responsibility for issues caused to the CUSTOMER by the use of the site and the technologies employed if not dependent on its own will, such as, by way of example: a) errors, delays, or inability to access the site by the CUSTOMER during the purchase procedure; b) errors, delays, or inability to receive communications from FTCOOP regarding the sale of PRODUCTS.

6.3 In any case, FTCOOP undertakes, to the extent possible, to resolve any problems that may occur and provide the necessary assistance to the CUSTOMER to obtain a rapid and satisfactory solution to these issues.

7. PRICES AND PAYMENTS

7.1 The prices of PRODUCTS are those actually displayed on the site at the time the ORDER is placed and, unless otherwise specified, include VAT. Shipping and delivery costs will be added to the prices listed on the site for each PRODUCT and will be highlighted and summarized before placing the ORDER and subsequently also in the ORDER CONFIRMATION.

7.2 The total price for the purchase of PRODUCTS and shipping costs, as indicated in the ORDER, will be charged to the CUSTOMER at the time of payment.

7.3 The CUSTOMER can use various payment methods to make purchases on www.intrentino.com: PayPal, credit cards, prepaid cards.

All transactions take place via the Shopify system, except for purchases made through PayPal, to which the CUSTOMER will be redirected at the time of purchase without further registration. Payment information remains exclusively within the PayPal system. The website www.intrentino.com uses SSL encryption to ensure the confidentiality of information transmitted online. Selecting “credit card or PayPal” at order confirmation redirects directly to PayPal, where the “Don’t have a PayPal account?” link is available.

PayPal:
PayPal allows the CUSTOMER to pay by accessing their account directly. Account and card data are managed directly by PayPal, which simply notifies www.intrentino.com of the payment. At order confirmation, selecting “credit card or PayPal” redirects to PayPal, and instructions must be followed to complete payment.

Cash on delivery:
“Cash on delivery” means a shipment where PRODUCTS are paid in cash by the CUSTOMER upon delivery according to an agreement between FTCOOP and the CUSTOMER. This option is only available if www.intrentino.com allows selection of “Cash on delivery” and involves cash payment only. Additional shipping costs for this service are already included in shipping fees. Such costs are not refundable in case of product return, except in case of order cancellation. Cash on delivery is allowed only for orders not exceeding €999.00. If available, the designated courier collects payment in cash from the CUSTOMER and delivers it to FTCOOP. Once an order is booked, it is not possible to add or modify the cash-on-delivery service.

8. DELIVERY OF PRODUCTS

8.1 Products are provided by the COOP members to the shipping logistics center. To ensure the freshness and authenticity of the products, shipments take place weekly, on Mondays and Wednesdays.

Orders containing items marked as “AVAILABLE” will be shipped on the first available shipping day and delivered to the customer within 4 working days in Italy, as detailed in the “shipping conditions” link.

Registered users can monitor the status of their ORDER in the “My Orders” section of the site using their username and password or by following the tracking code provided in the order summary.

8.2 Upon delivery of the PRODUCTS by the designated carrier, the CUSTOMER must check: a) that the quantity and type of PRODUCTS ordered correspond to the delivery note; b) that the packaging used for transport is intact, not damaged, wet, or otherwise altered, including closure materials.

8.3 Any anomalies must be reported immediately to the carrier at the time of delivery, indicated on the delivery note. To facilitate and speed up anomaly checks by FTCOOP, the CUSTOMER may also email ordini@intrentino.com.

8.4 Delivery requires the presence of the CUSTOMER or a designated person over 18 at the address indicated in the ORDER. In case of failed delivery due to absence, additional costs for storage and re-delivery will be charged to the CUSTOMER.

9. WITHDRAWAL, RETURNS AND REFUNDS

As fresh and perishable food products cannot be returned due to risk of rapid deterioration, alteration, or short shelf life, the CUSTOMER does not have the right of withdrawal.

However, if the CUSTOMER receives PRODUCTS that are damaged or different from the order, they will be collected by the courier and replaced at no additional cost.

In this case, the CUSTOMER must report the defect within two months of discovery by sending a communication or email to ordini@intrentino.com, including photos showing the defect, the production batch, the expiration date, and contact details for arranging collection.

Reports will be invalid if sent more than two years after purchase.

Sealed products opened by the CUSTOMER cannot be replaced under any circumstances.

10. ORDER CANCELLATION AND MODIFICATION

10.1 The CUSTOMER may cancel or modify the entire ORDER by 10:00 AM on the day following the order placement.

11. PERSONAL DATA PROTECTION

11.1 FTCOOP and the participating COOP guarantee the CUSTOMER that personal data acquired in connection with the sale of PRODUCTS will always be processed lawfully and correctly, in full compliance with EU Regulation 679/2016 and Legislative Decree 30 June 2003, n. 196 (hereinafter “DECREE”) as set out in the Privacy Policy published on the site.

11.2 For information on personal data processing, see FTCOOP’s privacy notice provided to the CUSTOMER upon registration on the site pursuant to Article 13 of EU Regulation 679/2016.

CUSTOMER data entered on the site will also be processed by FTCOOP in compliance with national and international law. FTCOOP’s privacy policy is available via the link at the bottom of the homepage.

12. COMMUNICATIONS

For any assistance or complaints regarding purchased PRODUCTS, the CUSTOMER may contact FTCOOP at ordini@intrentino.com.

13. SERVICE SUSPENSION

In case of serious breaches attributable to the CUSTOMER (e.g., non-payment, repeated absence during delivery, improper use of purchase methods), FTCOOP reserves the right to suspend the service and/or delete the CUSTOMER’s profile, with timely written notice.

14. LIABILITY

FTCOOP guarantees the cold chain and, in general, quality standards for products only until delivery to the CUSTOMER. FTCOOP is not responsible for product deterioration due to improper storage after delivery.

Except in cases of willful misconduct or gross negligence, FTCOOP declines any liability for direct or indirect damages of any kind resulting from the use of the site or its content, including information, photos, and data.

15. DISPUTE RESOLUTION TOOLS

In accordance with Article 14 of EU Regulation 524/2013, EU consumers are informed that disputes regarding this contract and online services may be submitted to Online Dispute Resolution (ODR) via https://webgate.ec.europa.eu/odr/. Other ODR platforms include the Milan Arbitration Chamber (Risolvionline.com) or Concilianet provided by a pool of Italian Chambers of Commerce. COOP and FTCOOP do not adhere to Alternative Dispute Resolution (ADR) for extrajudicial dispute resolution.

16. CONTRACT LANGUAGE AND APPLICABLE LAW

The GTC are governed by Italian law, specifically Legislative Decree 6 September 2005, n. 206 “CONSUMER CODE” and Legislative Decree 9 April 2003, n. 70 regarding certain e-commerce aspects.

As delivery is limited to Italy, the contract language is Italian.

17. JURISDICTION

Except for cases involving the consumer, any dispute regarding the sale of PRODUCTS, including their validity, interpretation, execution, or resolution of these GTC, will be exclusively subject to the Court of Trento.
